Terms and conditions (art)

General knowledge
• Prices are subject to change based on demand.
• I have the right to reject any order for any reason.
• Artworks will contain a subtle watermark that you may not remove.
• The currency accepted is Euros and can be paid through Stripe, Ko-fi or Paypal. If the client does not have access to either of these websites, then they may ask if they can pay through other means. I cannot guarantee that I will say yes.
• Commissions are to be paid 100% upfront or 50% upfront and 50% after sketch approval.
• Don't send me any payment before I have agreed to give you a slot and requested you to send me the payment.
• The time it takes to finish your commission varies 1 week - 3 months depending on factors such as health, the complexity of the commissioned piece, other work, and con seasons.
• If, for whatever reason, it takes me longer than 3 months to finish your commission, I will automatically cancel the commission, and you will receive a full refund (no kill fee). You will receive the commission as is.
• Once the piece is finished you will receive the full-resolution image. Note that there is no physical product.
• A fee will be added if you want something changed on the final drawing - unless a misunderstanding from my side has been made.
• If you wish for me to change something in the drawing you have previously approved, I will charge you a fee to change it. The amount of the extra charge depends on the change you want me to make and is usually based on an hourly wage.
• I will not work off of purely text description. Please provide me with some sort of visual reference, even if it's just a moodboard, along with a text description.
• If your reference is unclear to start with changes will come at an extra charge.

•I, Deathtooksheeps (the artist):
• reserve the right to cancel and refund the order at any time for any reason.
• retain all copyrights over the commissioned artwork.
• will NOT claim the intellectual property (IP) of the commissioned artwork (your characters are still yours, etc.)
• will NOT profit further from the commissioned artwork unless you (the customer) break any of the terms.
• reserve the right to post the commissioned artwork online, in my portfolio as well as in publications such as art books.• You (the customer/commissioner):
• You may upload the commissioned artwork on any website and social channels.
• You may NOT make profits from the commissioned piece (reselling, redistributing, uploading to POD, services, making prints for selling, etc.)
• You may NOT alter the commissioned artwork without my (the artist's) consent.
• You MAY be allowed to sell the artwork if it is a part of an Adoptable. Please discuss this with me (the artist) prior to paying for the artwork though.
• You retain the rights to the intellectual property (IP).
• You may NOT use the commissioned artwork for commercial purposes.
• You may NOT use the commissioned artwork in AI images, feed to an AI generator, or ANYTHING ELSE related to AI. I will consider it theft of IP.• The following is considered copyright infringement:
• Reproducing/using the copyrighted artwork commercially - means making money off it in any way not excluded from these terms.
• Claiming the artwork as your own.
• Altering the artwork without my consent.•Refunding
• The buyer is not allowed a refund once I started working on the commission.
• If for any reason I am unable to start your commission you will receive a full refund.
• If you cancel your order before I started it, you can get a full refund.
• The kill fee for canceling the commission after work has begun is 50% of the commission's price. The client then receives the work as is.
• If the buyer wishes to cancel the commission after the work has started, the buyer can be issued a refund but agrees to pay the kill fee. If the buyer does not pay the kill fee but wants the commission cancelled anyways, they get sent the art as is and get put on my blacklist.If you have read the ToS, please use the corresponding emoji when you contact me. • You have to own a carrd account. If you do not own pro, please let me know beforehand.

• Websites will contain a subtle watermark that you may not remove.
• The currency accepted is Euros and can be paid through Stripe, Paypal or Ko-fi. If the client does not have access to either of these websites, then they may ask if they can pay through other means. I cannot guarantee that I will agree.
• Fees are to be paid 100% upfront or 50% upfront and 50% after layout / concept approval.
• Don't send me any payment before I have agreed to give you a slot and requested you to send me the payment.
• The time it takes to finish your commission varies 1 week - 3 months depending on factors such as health, the complexity of the website, other work, and con seasons.
• If, for whatever reason, it takes me longer than 3 months to finish your commission, I will automatically cancel the commission, and you will receive a full refund (no kill fee). • Once the website is finished you will receive the website on your carrd account, or a template of the website if you do not have pro.

• You MAY use the website for commercial use, but ONLY IF I was informed before starting and agreed.

Terms and conditions (adopts)

General knowledge
• Prices are subject to change based on demand.
• REFUNDS ARE NOT POSSIBLE AFTER PURCHASE.
• The currency accepted is Euros and can be paid through Stripe or Ko-fi. If the client does not have access to either of these websites, then they may ask if they can pay through other means. I cannot guarantee that I will agree.
• Fees are to be paid 100% upfront or 50% upfront and 50% after about 3 weeks have passed (time may vary depending on the adopt).
• You will receive the adopt once you have paid 100% of the money you owe.
• If for some reason you cannot make the payment in time, tell me. I will put the adopt on hold. If you are completely unable to make the rest of the payment, you will be refunded the money you paid and the adopt will be repossessed.
• The adopt will only get sent to you after 100% of the payment has been made. If the 3 weeks pass without payment and with no notice that you cannot make the payment, you get blacklisted.
• Don't send me any payment before I have confirmed that you get the adopt and asked you to send me payment.
• You can edit the character, however they MUST be recognisable as that same character. (Means you can change their outfit, hair style, accessories etc. without worry but changing anything else might make them unrecognisable)•I, Deathtooksheeps (the artist):
• remain the original designer of the character and the artwork it was sent with (unless specified otherwise). You may NOT claim that you made the art, or came up with the character.
• will NOT profit further from the adopt or resell / trade the adopt unless you (the customer) break any of the terms.
• reserve the right to post the adopt in my portfolio.• You (the customer/commissioner):
• You can commission work of the character from myself or other artists.
• You MAY resell, but only if I was asked first (and agreed).
      • If you resell to someone on the blacklist, you also get        blacklisted.
      • Any additional commissions or art can be added to the resale        price.
• You can include the adopt in personal projects.
• If you break any of these terms, you will get put on a blacklist, which will prevent you from getting any kind of service from me in the future.
